Welcome to Family Legacy Plus!
By accessing or using our public website at familylegacyplus.com, our proprietary Customer Relationship Management platform at crm.familylegacyplus.com (the "Platform" or "CRM"), and any related tools, features, application forms, or services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms").
If you are submitting an application or using the Services on behalf of an agency or entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree to these Terms, please do not use the Services.
We may update these Terms from time to time. We will post the new effective date at the top. Material changes will trigger a re-acceptance prompt the next time you sign in to the Platform. Your continued use of the Services after changes constitutes your acceptance of the updated Terms.
Family Legacy Plus is an independent Health & Life insurance agency headquartered in the Greater Houston area. We operate a public website where prospective clients and prospective agents/agency owners can learn about us and submit applications, and a secure, proprietary SaaS platform built exclusively for our contracted agents and agencies. The Platform helps with client management, insurance quoting, policy tracking, lead management, and related activities — all designed to support your work with us.
You must be at least 18 years old to use any of the Services, including submitting applications through the public website.
To access the CRM Platform, you must be a currently contracted agent or agency with Family Legacy Plus in good standing.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services solely for legitimate insurance-related activities tied to your relationship with Family Legacy Plus.
By using the Services, you consent to receive notices, agreements, disclosures, and other communications from us electronically — including via email at the address you provided at registration or on an application form, and via in-platform messages. You agree that these electronic communications satisfy any legal requirement that such communications be in writing, and that your electronic acceptance of these Terms constitutes your signature under the Texas Uniform Electronic Transactions Act (Tex. Bus. & Com. Code Ch. 322) and the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. §7001 et seq.).
Your acceptance of these Terms — whether at sign-in to the Platform or at the time of submitting an application form on this website — is recorded with a timestamp, the version number of the Terms accepted, and audit metadata (such as your user agent string). This electronic record is admissible as evidence of your agreement.
You retain ownership of any information you submit through the Services, including application data you provide on this website and client data you upload to the Platform ("Your Data"). By submitting Your Data, you grant us a royalty-free, worldwide license to host, process, transmit, and use it as necessary to provide, protect, and improve the Services.
You agree not to (and not to allow others to):
We may monitor usage to ensure compliance and protect the Services.
All rights, title, and interest in the Services (including software, designs, workflows, templates, algorithms, marketing copy, and content) belong exclusively to Family Legacy Plus. These are protected by U.S. copyright, trademark, trade secret, and other intellectual property laws. Nothing in these Terms transfers any ownership rights to you.
Any feedback or suggestions you provide become ours, and we may use them without compensation.
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect information, including compliance with the Gramm-Leach-Bliley Act (GLBA), the Texas Data Privacy and Security Act (TDPSA), and other applicable laws. Please read it carefully.
You are responsible for obtaining all necessary consents and rights before uploading any client data and for complying with privacy laws in your own activities.
The Services rely on third-party infrastructure providers (including but not limited to Supabase for database services and Netlify for hosting). Your use of the Services is also subject to those providers' applicable terms where they apply. We use commercially reasonable efforts to maintain availability but are not responsible for outages, delays, or issues caused by third-party providers, internet connectivity, or factors beyond our reasonable control.
We may suspend or terminate your access to the Services at any time, with or without notice, for breach of these Terms, termination of your contract with us, or any other reason.
Upon termination:
The Services are provided "AS IS" and "AS AVAILABLE." To the maximum extent permitted by law, we disclaim all warranties — express, implied, or statutory — including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted access, error-free operation, or specific results.
From time to time we may make features available on a beta, preview, or experimental basis. Such features are provided as-is, may change or be discontinued at any time, and are not subject to any service-level commitments.
To the fullest extent permitted by law, Family Legacy Plus will not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or business opportunities) arising from your use of the Services, even if we have been advised of the possibility.
Our total liability shall not exceed the total fees you paid us (if any) in the twelve months before the claim.
You agree to indemnify, defend, and hold harmless Family Legacy Plus, its owners, officers, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from:
Neither party shall be liable for any failure or delay in performance arising from causes beyond its reasonable control, including natural disasters, war, terrorism, pandemics, government action, labor disputes, internet or utility outages, or third-party infrastructure failures.
We may assign or transfer these Terms and our rights and obligations under them to any successor, affiliate, or in connection with a merger, acquisition, or sale of our business. You may not assign these Terms or transfer your account without our prior written consent. Any attempted assignment in violation of this section is void.
These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Fort Bend County, Texas, and both parties consent to the personal jurisdiction of those courts.
